Disposition Plan | Patient files involving sexual violence and/or sexual misconduct, which is defined in the "no limitation period" clauses in Ontario's Limitations Act, will be kept for 99 years after the retention trigger, then be destroyed. The rest of the files to be destroyed 15 years after the retention trigger. Note: The Physical Therapy Clinic officially closed on October 1, 2021. |

B s.4Unless this Act provides otherwise, a proceeding shall not be commenced in respect of a claim after the second anniversary of the day on which the claim was discovered. Policies of Governing Bodies of Rehabilitation Therapy Services PractitionersRegistered physiotherapists, occupational therapists, chiropractors, chiropodists, and massage therapists are governed by the College of Physiotherapists of Ontario, the College of Occupational Therapists of Ontario, the College of Chiropractors of Ontario, the College of Chiropodists of Ontario, and the College of Massage Therapists of Ontario, respectively. All of them recommend keeping patient records for at least 7 or 10 years from the latter of the date of the last entry or the date on which the patient became or would have become 18 years old. However, The Physical Therapy Clinic retains its records in alignment with other health professionals, pursuant to the Limitations Act s.15 (2) - No proceeding shall be commenced in respect of any claim after the 15th anniversary of the day on which the act or omission on which the claim is based took place. 2002, c. 24, Sched.
